Intellectual Property

Trademark Law

A trademark is a name, symbol, logo, or slogan adopted by a business or individual to identify its goods and services, and distinguish them from competing goods and services provided by others.

Adopting, using and registering a trademark gives the owner the right to prevent others from using the same or similar mark in a manner that would be deceptive, misleading, or confusing to the public. David Ellis provides clearance and availability searches; prepares, files and prosecutes applications to register trademarks before the U.S. Patent and Trademark Offices, and assists in the enforcement of trademark rights in infringement actions on behalf of trademark owners and in defense of those accused of violating the trademark rights of others.

Copyright Law

Copyrights protect original works of authorship, literary works like books, articles, short stories, poems, and computer programs; musical and dramatic works, pantomimes and choreography, motion pictures and audiovisual works; pictorial, graphic, sculptural and architectural works; and original commercial databases. Copyrights do not protect underlying facts, ideas, procedures, processes, concepts, principles or discoveries, but only the particular way the underlying ideas are expressed in an original way.

The author of a copyrighted work has the right to prevent others from using the work without permission and to bring suit against violators who infringe the copyright. David Ellis can register your copyright with the U.S. Copyright Office, and prepare contracts and licensing agreements so that you can make money from your copyrighted works.
